PREAMBLE

The website nomadays.fr (hereinafter the "Site") is published by Nomadays, a travel agency registered in France.

Nomadays operates a platform enabling travelers to design and book trips in collaboration with partner local agencies specialized in their destination.

In this framework:

  • Nomadays notably ensures the marketing of trips, contracting with travelers, payment collection, administrative management of files as well as coordination of customer relations;
  • the partner local agency ensures the design of the trip, its operational organization, its execution on destination as well as local assistance for travelers;
  • the respective roles of Nomadays and the applicable local agency for each trip are specified in the contractual documents provided to the traveler.

These Terms and Conditions (T&C) govern access to and use of the Site by any user.

1.4 Local Partner Agencies

The trips presented on the Site are designed and executed on destination by the local partner agencies in the Nomadays network, each specializing in their destination.

The local agency acts as a local partner responsible for designing, operationally organizing and executing trips on destination.

The identity of the local agency applicable to each trip is specified on the website of the destination concerned as well as in the contractual documents provided to the traveler.

ARTICLE 2 — DEFINITIONS

Website: platform accessible at www.nomadays.fr.

User: any person browsing the Website.

Client: any person making a request or booking a trip.

Nomadays: travel agency registered in France operating the Website.

Local partner agency: local partner responsible for designing, organizing and executing the trip at the destination.

Services: all services offered via the Website.

ARTICLE 3 — SITE ACCESS

The Site is accessible free of charge to any user with internet access.

Nomadays endeavors to ensure continuous access to the Site without guaranteeing permanent availability.

Interruptions may occur notably for maintenance, updates or technical reasons.

ARTICLE 4 — ROLE OF THE PARTIES

4.1 Nomadays' Role

Nomadays acts notably in the capacity of:

  • a travel agency registered in France;
  • a contractual contact for the traveler;
  • a booking and file management platform;
  • an interface between the traveler and the partner local agency.

Nomadays notably ensures:

  • the presentation of trips;
  • the conclusion of contracts with the traveler;
  • the collection of payments;
  • the administrative management of files;
  • the transmission of information necessary for organizing the trip;
  • traveler support in case of difficulty or complaint.

4.2 Role of the Local Partner Agency

The local partner agency is responsible notably for:

  • designing the trip;
  • selecting local service providers;
  • making the necessary bookings for trip execution;
  • organizing the operational logistics of the stay;
  • providing on-the-ground assistance to travelers;
  • managing operational incidents at destination.

4.3 Assistance and Coordination

In case of difficulty during the trip, the partner local agency intervenes as a priority to find an appropriate solution.

The traveler can contact either the partner local agency or Nomadays.

Nomadays supports the traveler and acts as a coordination interface with the local agency to facilitate the resolution of any difficulties encountered.

The parties cooperate to ensure the proper execution of the trip and the traveler's satisfaction.

ARTICLE 5 — USER OBLIGATIONS

The User agrees to:

  • use the Site in compliance with applicable law;
  • not interfere with the Site's operation;
  • provide accurate information when making requests or bookings.

Access credentials to the customer portal are strictly personal and confidential.

ARTICLE 6 — SITE LIABILITY

Nomadays shall not be held liable for:

  • temporary interruptions to the Site;
  • issues related to telecommunications networks;
  • improper use of the Site by the User;
  • events beyond its control affecting access to the Site.

Liability conditions relating to the performance of the trip are governed by the terms and conditions of sale and contractual documents provided to the traveler.

ARTICLE 7 — INTELLECTUAL PROPERTY

All content on the Site, including texts, images, videos, illustrations, logos, databases and software, is protected by intellectual property provisions.

Any reproduction, representation, distribution or exploitation, in whole or in part, without prior written authorization from Nomadays is prohibited.

ARTICLE 8 — PERSONAL DATA

Personal data processing is carried out in accordance with applicable regulations, in particular the General Data Protection Regulation (GDPR).

The complete terms of data processing are described in the Privacy Policy accessible from the Site.

ARTICLE 9 — EXTERNAL LINKS

The Site may contain links to websites operated by third parties.

Nomadays cannot be held responsible for the content, services or policies applied by these external sites.

ARTICLE 10 — AMENDMENTS

Nomadays reserves the right to modify these Terms and Conditions of Use at any time.

The applicable version is the one published on the Site on the date of consultation or use.

ARTICLE 11 — GOVERNING LAW

These Terms and Conditions of Use are governed by French law.

Any dispute relating to their interpretation or performance shall be subject to an attempt at amicable resolution before any legal proceedings.
